Law

Becoming Barristers

There are different ways of getting qualified to be admitted as a barrister in Hong Kong.

According to section 27(1) of the Legal Practitioners Ordinance (Cap. 159), a person is qualified for admission as a barrister if he:

(a) is a holder of a Postgraduate Certificate in Law (PCLL);
(b) is a solicitor in Hong Kong; or
(c) is an overseas lawyer

Post-graduate Certificate in Laws

Post-graduate Certificate in Laws (PCLL) is a pre-requisite for entering the Bar Profession. It is a practical legal training programme which allows its graduates to proceed to pupillage.

A person, who has completed his Bachelor of Laws (LLB) or Juris Doctor (JD) or equivalent legal studies in other common law jurisdictions, is eligible for admission to the PCLL in one of the three universities, namely the University of Hong Kong, the City University of Hong Kong or the Chinese University of Hong Kong.

Becoming a Barrister

One of the ways to become a lawyer in the UK is to become a barrister. A barrister must first complete Academic Training—meaning a law degree or an unrelated degree followed by a conversion course (or Graduate Diploma in Law). Instead of training in a law firm like a solicitor, a barrister candidate will take the Bar Course Aptitude Test (BCAT) and, if successful, join an Inn of Court.

Once the candidate joins one of the four Inns of Court (Middle Temple, Inner Temple, Gray’s Inn and Lincoln’s Inn) they undertake the Bar Professional Training Course (BPTC) over one or two years for Vocational Training. Once this is successfully completed and any extra training is undertaken, the Inn “Calls” you to the Bar.

Once you’re Called to the Bar, you become an unregistered barrister. You can’t practise as a barrister until completing the final stage—the pupillage. This is practical work experience/Work-Based Learning under an experienced barrister, and it’s very competitive to get a place.

After one year, the supervising barrister can recommend that you’re ready to work as a barrister. You can then apply for a Practising Certificate. The barrister can then apply for ‘tenancy’ of a set of Chambers—a group of Counsel who share the costs of premises and support staff, while remaining individually self-employed.

Solicitor

Law Degree Graduates – the Traditional Route to Becoming a Solicitor in the UK

Wherever they wish to become a UK lawyer, most people start their journey with obtaining a university law degree (LLB). This known as the Qualifying Law Degree (QLD), which can be completed in one of the 100+ institutions offering this degree in the UK.

The next step is to complete the Legal Practice Course (LPC) which is the vocational stage of training, and finally a two-year training contract at a law firm prior to qualification.

It is possible to obtain a law degree/complete a training contract in one jurisdiction (such as Scotland) and later practise law in England and Wales so long as an appropriate conversion course is undertaken in England or Wales.

To become a practicing lawyer in Canada, you need two to four years of a university program and a Juris Doctor/Bachelor of Laws degree from a recognized law school. Next, you must complete a period of articling, a bar admission course and exam, and be licensed in the province/territory where you plan to work. Expect a commitment of six to eight or more years.

Students must complete a Bachelor of Laws (L.L.B.) program or Juris Doctor (J.D.) program in order to qualify for bar membership in any Canadian province or territory. This generally takes three years to complete.

Manitoba (Law Society of Manitoba )

Saskatchewan (Law Society of Saskatchewan)

Nova Scotia (Nova Scotia Barristers Society)

  1. Complete a Bachelor of Law (LLB) undergraduate degree or a Juris Doctor (JD) postgraduate degree. Both courses are 3 or 4 years long.
  2. Complete Practical Legal Training (PLT). This can be completed in less than a year.
  3. Gain admission from the relevant state or territories Admissions Authority within 5 years of graduation.
  4. Apply for a Practising Certificate from the local Law Society.
  5. Complete 18 to 24 months of supervised practice at a law firm. It may be preferable to complete this in a law firm that specialises in your chosen field.

To become a lawyer in New Zealand, you are required to:

  • complete a Bachelor of Laws Degree (LLB) or LLB (Honours) degree approved by the New Zealand Council of Legal Education
  • complete a Professional Legal Studies Course
  • obtain a Certificate of Completion from the NZCLE, and
  • be admitted to the roll of Barristers and Solicitors of the High Court of New Zealand and
  • hold a current practising certificate issued by the New Zealand Law Society (NZLS).

To be admitted to the bar you must complete a three-month Professional Legal Studies course after completing the LLB or LLB(Hons) degree. There are currently two providers of this course:
The Institute of Professional Legal Studies
The College of Law (New Zealand)
